Hillary!TM decided to open her mouth today, joining the chorus of idiots who can’t count and support the filibuster of Alito. However, it’s her complete confusion about the role of the Supreme Court that I find the most disconcerting.

From the New York Daily News:

Sen. Hillary Clinton yesterday backed a rebel band of Senate Dems seeking to filibuster a vote on the Supreme Court nomination of Judge Samuel Alito. Democratic leaders had warned that filibuster efforts were going nowhere and would let President Bush score easy political points, but Clinton said, “I oppose his nomination and support efforts to block his confirmation.”

“I do not think Judge Alito would advance the principles Americans hold most dear,” she said, adding she would vote against a move to cut off a filibuster should one occur.

Where exactly does this sort of thinking come from? Being stupid doesn’t count in this case because there are many smart people who would agree with her. Look people, and for my liberal friends I’ll speak slowly and use simple words so as to avoid any confusion, the supreme court isn’t supposed to “advance” anything, much less anything as ambiguous or ever changing as “principles that Americans hold most dear.” Their job is perhaps the simplest (not easy, mind you, just simple) job in all of government: they look at the cases in front of them and simply rule them constitutional or unconstitutional using citations from the Constitution itself or federal law. They are not supposed to create law. They are not supposed to forward anything. They are not the players of the game; they are only the referees.

If Hillary!TM wants to advance anything, she’s in luck because she is a legislator and, holy crap, that’s her job!! Unfortunately, it’s not the job of the Supreme Court.

today’s NYT’s:

If Judge Samuel Alito Jr.’s confirmation hearings lacked drama, apart from his wife’s bizarrely over-covered crying jag, it is because they confirmed the obvious. Judge Alito is exactly the kind of legal thinker President Bush wants on the Supreme Court. He has a radically broad view of the president’s power, and a radically narrow view of Congress’s power. He has long argued that the Constitution does not protect abortion rights. He wants to reduce the rights and liberties of ordinary Americans, and has a history of tilting the scales of justice against the little guy.

Nominee, errr, I mean SUPREME COURT CHIEF JUSTICE John Roberts (how does that sound libby? Stick it in yer craw and choke!!) faced a similar attack during the nomination hearings. When he was asked if he would “stick up for the little guy,” his response was truly wonderful. I don’t remember it verbatim, but it was something like, I’ll stick up for the little guy when he is in the right as far as the law is concerned. If the law as written favors the “big guy,” then my obligation is to enforce the law and vote for the big guy.

And there it is in all of stark glory – the huge divide separating the how the left and the right view the SCOTUS. The left believe that the Nine in black robes should serve as some sort of philosopher kings or a super-legislature, constantly having the final say of what is truly “right,” even if that standard moves over time. Whereas conservatives simply want the SCOTUS to behave in the manner provided by the constitution, namely act as the refs or the umps (pick your sport) of the game at hand.

Stupid Abortion Chick

Yeah. Bloody dress to protest Alito over Roe v Wade. I know what she is trying to say, that if abortion is made illegal (which anyone with an ounce of grey matter upstairs knows that the Supreme Court cannot make abortion illegal, it can only reverse its stance that abortion is a constitutionally protected right. It would then kick to the states for them to make up their own minds, through the legislative process, to either allow it, allow it with restrictions, or ban it outright.) women will be forced into the back alley with rusty hangers when they have no where else to turn. But last time I checked, abortion itself is a pretty bloody activity. I suppose this chick is only concerned about her blood and not that of any unborn children.

Oh, now I get it. My bad.

I wish I had an automatic transcript device. Judge Alito just blew Chuck Schumer out of the water on abortion. After holding up his Robert Byrd TM mini-Constitution, Schumer demanded several times whether he still believes as he wrote in his 1985 memo that he doesn’t think abortion has Constitutional protection. Alito demurred each time, saying that he would have to weigh each case in light of its facts and its reliance on precedence. Like the bad lawyer he has proven himself to be, Schumer asked one question too many:

Q: Does the Constitution protect free speech?

A: Yes, Senator, the First Amendment protects free speech.

Q. Well, why can you give me a straight answer on that issue but not give me a straight answer on abortion?

A. Because the text of the Constitution explicitly includes the term “free speech”.

Case closed. It’s like watching the Washington Generals play the Harlem Globetrotters.
